Welcome to Requset. These Terms of Service ("Terms") govern your access to and use of our websites, applications, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. Eligibility

You must be at least the age of majority in your jurisdiction to use the Service. You may not use the Service if you are barred under applicable law or are located in a jurisdiction subject to comprehensive sanctions.

2. Account Registration and Security

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activities under your account. Notify us immediately of any unauthorized use or security incident.

3. Acceptable Use

You agree not to misuse the Service. Prohibited activities include, without limitation:

• Violating any applicable law, regulation, or third‑party rights (including privacy and IP).
• Uploading malicious code, attempting to bypass security, or probing vulnerabilities.
• Accessing data or accounts without authorization, or sharing credentials improperly.
• Copying, reverse engineering, or creating derivative works except as expressly permitted.
• Abusive behavior, spam, or content that is unlawful, harmful, or deceptive.
• Exceeding fair‑use limits, including excessive API calls or automated scraping.

4. Customer Data and Privacy

"Customer Data" means data, content, files, or information submitted to the Service by you. You retain ownership of Customer Data. We process Customer Data to provide and improve the Service, consistent with our Privacy Policy and applicable data protection laws.

5. Security

We implement administrative, technical, and organizational measures designed to protect Customer Data. However, no method of transmission or storage is completely secure, and we do not guarantee absolute security.

6. Intellectual Property

We and our licensors retain all right, title, and interest in and to the Service, including software, documentation, and trademarks. Except for the limited rights expressly granted in these Terms, no rights are granted by implication or otherwise.

7. Subscriptions, Fees, and Billing

Access to certain features may require a paid subscription. Fees are billed in advance and are non-refundable except as required by law or expressly stated. You authorize us (and our payment processors) to charge your payment method for the applicable fees and taxes. Plans may auto-renew unless you cancel before the renewal date.

8. Free Trials and Beta Features

We may offer free trials or beta features at our discretion. Trials and beta features are provided "as is" without warranties and may be modified or discontinued at any time.

9. Term and Termination

These Terms remain in effect until terminated. You may stop using the Service at any time. We may suspend or terminate access for any violation of these Terms or if continued access creates risk to the Service or others. Upon termination, your right to use the Service ceases, but sections that by their nature should survive will survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification).

10. Service Changes and Availability

We may modify, discontinue, or change the Service or features at any time. We use commercially reasonable efforts for availability, but the Service may be unavailable due to maintenance, outages, or factors beyond our control. Unless otherwise agreed in writing, no service level credits apply.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You will defend, indemnify, and hold harmless Requset and our affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, Customer Data, or violation of these Terms.

14. Confidentiality

Each party may receive confidential information from the other. The receiving party will protect such information using reasonable care and use it only as necessary to perform under these Terms. This obligation does not apply to information that is public, already known, independently developed, or rightfully obtained from a third party.

15. Compliance and Export

You are responsible for compliance with all applicable laws, including data protection, anti-bribery, and export control laws. You will not export or re-export the Service in violation of applicable export laws or regulations.

16. Third-Party Services

The Service may interoperate with third-party products or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date below and, if changes are material, provide reasonable notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law; Dispute Resolution

These Terms are governed by the laws of the jurisdiction indicated below, without regard to conflict of laws principles. Any dispute will be resolved in the courts located in that jurisdiction, unless otherwise required by law. We both consent to personal jurisdiction and venue there.
